Baked social competition terms

1. General

a) Information regarding how to enter and the prizes form part of these Terms and Conditions.

b) Entry into the Baked Comment to Win (“The Promotion”) constitutes acceptance of these Terms and Conditions.

c) The Promoter is KIND Brand Pty. Ltd, Level 1, 4 Prohasky St, Port Melbourne VIC 3207.

d) For the purposes of these Terms and Conditions, KIND Brand Pty. Ltd. includes all related and subsidiary companies, past and present officers, agents, representatives, employees and assigns.


2. Entry Requirements

a) Entry is open to Australian residents aged 18 years or older only.

b) Individuals must have an Instagram account in order to access the promotional post and fulfil the entry requirements.

c) Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.

Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

d) Entry to The Promotion is free.

e) The Promotion commences at 00.00AM AEDT on Thursday 10th September 2026 and closes at 11.59AM AEDT on Friday the 18th of September, 2026 (“The Promotion Period”).

f) To enter the Promotion, participants must:

i) Visit the KIND Collective Instagram, https://www.instagram.com/kindcollectiveau/ and locate the promotional post.

ii) Input their entry in response to the competition prompt tell us in emojis what KIND beauty means to them as a comment on the promotional post (“Entry”).

iii) Follow the KIND Collective’s Instagram, https://www.instagram.com/kindcollectiveau/

iv) Submit their completed entry via public comment on the promotional post.

g) Only one (1) entry is permitted per person.

h) Incomplete or indecipherable entries will be deemed invalid.


3. Judging

a) This is a game of skill, and chance plays no part in determining the winner. Each entry will be individually judged on a combination of fulfilment of the entry requirements, creative merit and originality.

b) There will be two 3 Major Prize Winner/s selected.

c) Judging will take place at Communicado Marketing Communications of Level 1, 554 High Street, Prahran, Victoria 3181 from 09.00AM AEDT on Thursday the 1st of October 2026, and will be undertaken by a representative selected by The Promoter.

d) The Winner will be notified via Instagram private message within three (3) business days of the judgement occurring.

e) All Winners of The Promotion will be published in the copy of the promotional posts, identified by their username on Instagram where they submit their winning entry.

f) Should the Promoter be unable to make contact with any of the chosen winners within five (5) business days after reaching out via private message, the winner will be deemed to have forfeited the prize.

g) Should item 3f come into effect, a representative of The Promoter will select the next best entry/entries to be the Major Prize Winner and/or Runners Up of the The Promotion. This judging will take place at Communicado Marketing Communications of Level 1, 554 High Street, Prahran, Victoria 3181 at 09.00AM AEDT on Thursday the 7th of Setember, 2026.

h) The judge’s decision is final, and no correspondence will be entered into.


4. Prizes

a) Prizes:

1st prize: KIND bundle and Cake Club Voucher

Runners Up: Kind bundle each

b) The total prize pool is valued at $350 AUD.

c) The prize may not be transferred or substituted, except at the Promoter’s discretion. The Promoter reserves the right to substitute a prize of equal or greater value due to prize unavailability.

d) Any physical component of the Major Prize will be delivered to the addresses supplied by the Major prize winner.

e) The Promoter shall not be liable for any costs associated with the prize after delivery.

f) The Promoter shall not be liable for any loss or damage whatsoever that is suffered by any entrant or winner (including but not limited to indirect or consequential loss), or for any personal injury suffered or sustained as a result of taking any prize, except for the liability that cannot be excluded by law.


5. Entries

a) All entries must be original and will become the property of The Promoter upon submission. Entries may be used for future promotional, marketing and publicity purposes in any media worldwide.

b) The winner’s name and photographs may be used for any future promotional, marketing and publicity purposes in any media worldwide.

c) Entrants' personal information will be collected by the Promoter. Personal information will be stored on the Promoter's database. The Promoter may use this information for future marketing purposes regarding its products, including contacting the entrant electronically. The Promoter will handle personal information in accordance with its privacy policy which is located at www.wickedsister.com.au/privacy-policy/ . The Promoter collects personal information about entrants to enable them to participate in this Promotion and may disclose the entrants' personal information to third parties including its contractors and agents, prize suppliers and service providers to assist in conducting this Promotion. The entrant agrees to the Promoter sending them electronic communications regarding this Promotion (for administrative purposes only) and acknowledges that such communications may not have an unsubscribe facility. If the entrant does not provide their personal information as requested, they may be ineligible to enter or claim a prize in the Promotion.

d) The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

e) If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.


6. Warranties

a) Entrants agree they are fully responsible for any materials they submit as a component of their entry (“Entry”), including but not limited to their answer to the promotional question. The Promoter shall not be liable in any way for the content of their Entry, to the full extent permitted by law. The Promoter may remove or decline to publish any Entry without notice for any reason whatsoever. Entrants warrant and agree that:

i) they will not submit an Entry that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;

ii)their Entry shall not contain viruses or cause injury or harm to any person or entity;
